Sidewalks and walkways: the City's notice, the tree's roots, and your front walk

Under Cincinnati's code the public sidewalk in front of your house is yours to maintain. Here is how the repairs go, what the City expects, and the private walks we pour too.

Old public sidewalk slab heaved and cracked by a tree root, a trip-hazard step between panels, brick house and iron fence behind

Two different jobs share this page. The public sidewalk, in the right-of-way between your lot and the street, is City property that the City's code (Cincinnati Municipal Code section 721-149) makes the adjacent owner responsible for maintaining, and repairing it is permitted street work. Your front walk, garden path and side walkway are on your lot and are yours to do as you like. We do both, and the difference matters for who can do the work and what it costs.

Public sidewalk repair

Most of these jobs start with a notice from DOTE's Sidewalk Safety Program (801 Plum Street, Suite 450, 513-352-4503) listing the panels that need attention: heaved by a tree root, cracked through, sunk at a joint, or crumbling at the edge. The notice gives the owner three options: hire a licensed contractor, do it yourself, or let the City do it and bill the estimate. The notice guide walks through the paperwork; here is the work.

  • Replacement. The failed panel is saw-cut at the joints, broken out, the base re-compacted, forms set to match the neighbors, and a new panel poured to the City's sidewalk spec, broom-finished, jointed. Root pruning where a tree has lifted the panel, within what the City's urban forestry rules allow.
  • Grinding. A lip of an inch or less at a joint can sometimes be ground down to remove the trip hazard without replacing the panel. Cheaper, and the City accepts it for small offsets.
  • Lifting. A sunken panel with a sound surface can be raised with polyurethane foam to meet its neighbor. See the leveling page.

Because it's in the right-of-way, public sidewalk work inside the city needs the City's permit and a DOTE-licensed street contractor, the same as a driveway apron. We handle both. One more rule from the code worth knowing: a sidewalk that is actually a structural slab over a basement area or vault that extends under the walk is the owner's alone and needs a professional engineer's drawings; we'll tell you if that's what you have.

Who's responsible for which sidewalk

Under section 721-147, a commercial property or a residential property with four or more families maintains all sidewalks and driveways on every side. A residential corner lot with three families or fewer handles the frontage where the driveway is, otherwise the frontage of the street address. Mid-block, it's the frontage. If a notice names a panel you don't think is yours, the Sidewalk Safety Program is who to ask.

Private walks and paths

A front walk from the sidewalk to the porch, a path to the side gate, a walk around the garage. Four inches on a compacted base, 3 to 4 feet wide, pitched to drain, broom-finished or exposed aggregate, jointed every 4 to 5 feet. On a hillside lot a walk often becomes a set of steps partway, and the steps page picks up there. No permit for a private walk on your own lot in most cases; we check.

Cost

Published 2026 figures for sidewalks: $7 to $17 per square foot for new concrete, about $28 to $68 per linear foot for a 4-foot-wide walk, repair at $3 to $8 per square foot, removal $3 to $8, and remove-and-replace $10 to $25 or more per square foot (HomeGuide, Feb 2026). A City-notice job is priced per panel with the permit shown; the sidewalk repair cost page explains how to compare it with the City's estimate.

Questions about this work

I got a sidewalk notice. Do I have to use the City's contractor?

No. The notice gives three options: a licensed contractor of your choice, yourself, or the City's crew at the estimated cost. Get a written price from a licensed street contractor and compare it with the City's estimate before deciding.

Can the tree root be cut?

Within limits. Cutting major roots of a street tree can kill it or make it unstable, and the City's urban forestry staff have rules. Small roots under the panel are pruned; big ones usually mean the new panel is poured over or around them with a slight ramp.

What if only one corner of the panel is lifted?

Grinding the lip, if it's an inch or less, is often accepted and costs a fraction of replacement. More than that, replacement or foam lifting.

Does the new panel have to match the old ones?

It has to match the grade and width and be broom-finished; new concrete is lighter than the weathered panels beside it and darkens over a year or two.

How long is a sidewalk closed after a pour?

Walkable in a day or two with care; we keep it coned for 24 hours and ask that nobody roll a heavy bin across it for a week.

Will you handle the City permit?

Yes. Public sidewalk work in Cincinnati needs the right-of-way permit and a licensed street contractor, and both are part of our price.
